Examples of creating solutions to some of the ethical problems existing in Turkey, I wanted to share with you. I believe that we should not limit the concept of corruption to just the state, and we should also add behaviors that each individual is ethically wrong and thinks of their own interests. I’m starting the examples.
Case-1 : The newly appointed governor of the province, or the district governor appointed to the district, completely dismissed the furnishing of the newly furnished lodging, dispatching their children to school with the institution’s vehicle, allocating vehicles to their spouses by informal methods. Despite the fact that his institution is a lodge, the general manager has the housing for high fees. How familiar is that?
Case-2: The general manager of an institution has bought a house under rough construction. The owner of the firm, who conducts the tender works of the institution, offers to the general manager to complete the fine works and garden arrangement of his house for a symbolic fee. What should the general manager do?
Case-3 : Is it ethical for an inspector to request a free check-up from a private hospital he / she goes to inspect? Or should he accept the free check-up offer? Again, is it ethical for an auditor to distribute an annotated legislation book about the audit task to the public institutions he / she audits for the purpose of purchasing?
Case-4 : The imam, who works in the municipal cemetery, wants to give money to the owners of the funerals where he performed burials. Is it ethically correct for imams to get the money that funeral owners want to give?
Case-5 : The uncle of the science director sells construction materials. He requests his nephew, who comes to visit him, to direct the companies that do business to the municipality to buy materials from him. What should the manager do?
Case-6 : Is it ethical for the top manager of the institution to call the manager who will prepare the tender specification to the office before a big procurement tender to be made and ask a specific company to prepare the tender in such a way?
Solution For Case 1
The appointed district governor or governor should be examined on a monthly basis by independent upper-level people who do not have any political views (with state-approved permits). Another application may be the “partner system”. Each governor or district governor will have a partner, if one of these partners is corrupt, steals money from the state’s treasury or allocates state property to his own, his other partner will also be held responsible. With this system, one partner is spying on another, he will have to correct his mistakes and warn him to do his jobs properly. Briefly, We can ensure discipline and order through dual or triple partners.
Solution For Case 2
The general manager should not accept this attractive offer. If he accepts, a conflict of interest arises and he may be in a difficult situation if the owner of the company makes requests that do not comply with the legislation in the future. It is unethical to have such work done to people who have a business relationship with the institution, even at normal prices. The person who is in the position of general manager in an institution should not engage in such tender works with his identity representing the institution and should not use the name of the institution in his own works. In the price policy that the company owner applies, the person, institution, the community must sign a declaration that requires them to serve everyone equally regardless of the end of the job and forward it to an authority within the state to deal with these irregularities.The legal process should be put into effect and any necessary sanctions should be applied to the persons within the scope of any irregularity of the firm owner.
Solution For Case 3
It is against ethical behavior principles that public officials who are in the position of controllers demand services, opportunities or similar interests for them in violation of the legislation. Subjecting persons to be in the position of supervisors to special exams, they can come to their duties on the condition that they will comply with the regulation to be prepared by the state by a committee.
Solution For Case 4
Public officials receive a salary or salary from the government in exchange for their service. For this reason, it is not correct for the business owners to take a separate or cash price in return for their work. Legal regulations should be increased in this issue, sanctions on religion and private affairs should be increased.
Solution For Case 5
He must explain to his uncle that this behavior is not correct, and explain that if he directs firms to his company, a conflict of interest will occur. Individuals at the upper levels of the State should be responsible, fair and impartial. We can manage these individuals with the “group system” to be created. By taking these individuals from the top level into the group, their movements can be controlled, monitored legally, and intervened when the transparency in the decisions they make is open to investigation.
Solution For Case 6
It is not legal and ethical for the top manager to give instructions against the tender legislation. The manager should also not follow such an order. These are not only ethical violations but also disciplinary and judicial crimes. Fraudulent behaviors, violations of confidentiality, making agreements, using algebra and threats or other unlawful acts in the procurement process in the buying, selling, leasing, leasing and construction works carried out on behalf of the public or in the procurement processes carried out through public institutions (eg, contracts made under the bankruptcy law). Extended laws should be enacted under the name of preventing the tender from being done or concluded by performing the behavior.
